Hello to everyone. I hope I'm doing this right and posting in the right place. I'd like to ask a collections related question. I've been a paralegal for many years so I have a pretty solid legal background.
My newest client needs me to do collections and I don't have a lot of direct experience i this area. I had to do a debtor's exam (ORAP) recently and my question concerns how far I can go in such a setting. This is in California. Am I permitted to take any cash or property the witness has on hand? Is it permissible to demand the witness empty their pockets or purse? If the debtor is willing, and I don't coerce her or him in any way, am I permitted to accept the title to a motor vehicle? Can I ask them to go to an ATM and return with cash? I'm sure there are other obvious questions I'm missing and I pose these as examples but any thoughts or links regarding California ORAPs are much appreciated.

I think you may be on a fine line. If you are not a licensed bonded collection agency or a collection attorney I would stay away. What is the legal basis to use that you demand someone empty their pockets. Are you looking for assets and you think he would let you go through his wallet or anything else? The only time someone that to my knowledge do something like that is a bankruptcy trustee and that is if they see things in plain sight. Such as the woman that is filing Chapter 7 and comes in wearing all types of dazzling jewelry, the trustee can take it and sell it to repay the creditor. I do not think you are in a position to demand anything. If the individual is willing to do it voluntarily then perhaps. Be careful with this.

If your background doesn't consist of collection then I wouldn't stomp in unfamiliar territory. My wife is a property tax collection attorney and I wouldn't ask her to try and collect commercial debt for me. There are so many variables when it comes to laws regarding collection methods. Is your client trying to collect from a consumer or business? I'm not sure how effective telling someone to go to the ATM or empty their pocket would be. In most cases, when someone is looking to collect payment through a third-party most direct demands have been exhausted. Depending on the type of debt, you have to really think outside the box to motivate a debtor to pay a debt short of filing suit. I would recommend looking for a collection agency that specializes in what type of debt and industry your client is trying to collect from. My firm specializes in commercial debt and is fully licensed, bonded and insured. We have dedicated collectors that are industry specific and I don't have anyone on my staff with less than 15 years of experience. Hello everyone. Thanks for allowing me to be a member of this industry. My situation is difficult and I'm trying to do the best that I can. I recently ended my employment with a collection agency and trying to start my own with the help of my fiance. We established all that is required to efficiently be compliant. We purchased our first portfolio blindedly and somehow got stuck. The present file has no media, the file was batched with current numbers from Microbilt and I have been calling and initially sent out dunning letters, some have been returned. I would like to move forward in recouping whatever I can to purchase a more revelant and current file. Yes, I took a bullet (per say) for now but my wound will heal. What ever you do and what ever business you are in it is always important to network. How do you know that the person in front of you at the grocery checkout does not own a multi-million dollar corporation and have a great deal in unpaid claims. We can all use that to fall into. As you all know my contract with a company ended the end of May and I have been looking elsewhere for some time. Well I have secured a new position effective Monday June 18, 2012. If it is an oos portfolio that I can help you and refer you to an agency that is a specialist in oos paper. If your goal is to develop yourself as a collection agency then I would urge you to get some contingency paper and work that. That type of paper will get you a cash flow and then enable you to purchase more paper. Just my two cents. Steve
